General Product Safety Regulation (GPSR)

On January 16, 2025, the Government published a proposal (HE 213/2024) proposing a new Act on the Safety of Consumer Products and Consumer Services, and the repeal of the current Consumer Safety Act.

The proposal is related to the implementation of the EU General Product Safety Regulation (EU 2023/988) and aims to modernize national consumer safety regulation. The objective is to improve consumer safety, especially with the proliferation of new technologies and online sales, and to ensure regulatory consistency within the EU internal market.

According to the proposal, providers of consumer products and consumer services must ensure that their products and services are safe in their normal use. This includes the obligation to assess risks, manage them effectively, and report serious risks or incidents to supervisory authorities (the Finnish Safety and Chemicals Agency, “Tukes”). Clear instructions for use and warnings must be provided with the products, and they must be available in Finnish and Swedish.

Consumer service providers are required to perform continuous safety monitoring and risk management. Providers must identify and assess risks associated with services, document measures, and promptly report serious accidents or near-miss situations. Stricter safety requirements apply in particular to services that are dangerous or carry a high risk, such as sports and entertainment services.

Regarding supervision, the proposal provides for expanded enforcement powers for Tukes and Customs, allowing them to better intervene against dangerous products and services. Operators can be ordered to pay administrative fines of up to 1% of the company’s turnover or up to EUR 100,000 if safety requirements are violated.
